Terms & Purchase Policy

These terms apply to every website project ordered from Agony Studios (“we”, “us”). By placing an order you agree to them. If anything is unclear, ask us before you pay.

1. Services

We design and build websites for businesses, creators, FiveM communities, restaurants, brands and individuals. The scope of each project is defined by the plan you choose (for example the number of pages), any add-ons you select, and what we agree with you in your order ticket.

2. How ordering works

All purchases are handled through tickets on our Discord server.

• Join our Discord (discord.gg/92hCXbEgX4) and open a ticket.
• Tell us the plan and add-ons you want and describe your project.
• We confirm the scope, price and timeline in the ticket before any payment is made.
• Your order is confirmed once we have received your payment.

3. Prices and payment

• Prices are shown in euro (€) on our website. The price confirmed in your ticket is the price you pay.
• Payment is made in advance via PayPal unless we agree something else in writing in your ticket.
• Custom work outside the chosen plan is quoted separately before we start it.

4. Your content

You provide the texts, images, logos and other material for your website, or tell us which placeholders to use. You confirm that you have the rights to everything you send us and that it doesn’t break any law. We aren’t responsible for content you provide.

5. Delivery and timeline

We give you an estimated timeline in your ticket. Timelines depend on receiving your content and feedback on time; delays on your side move the delivery date accordingly. The Priority Delivery add-on moves your project to the front of our queue.

6. Revisions

We share progress with you and include reasonable revision rounds within the agreed scope. Changes that go beyond the agreed scope (for example new pages or features) are treated as additional work and quoted separately.

7. No-refund policy

All sales are final. Payments are non-refundable once your order has been confirmed. This applies to all plans, add-ons and paid updates, including if you change your mind, no longer need the website, or do not provide the content needed to complete it.

Because every website is custom-made for you, we begin work immediately after payment. By placing an order, you expressly request that we start before the end of the statutory withdrawal period and you acknowledge that you lose your right of withdrawal once the service has been fully performed. If you are a consumer in the EU and withdraw before the service has been fully performed, you owe a proportionate amount for the work already carried out (§ 357a BGB).

This does not affect your statutory rights. If we fail to deliver the agreed service, or the delivered website has a defect we are responsible for, we will first fix it; if we cannot, the statutory remedies apply.

Please make sure you are happy with the plan, add-ons and scope confirmed in your ticket before you pay. If you are unsure about anything, ask us first.

8. Ownership and updates

Before delivery, we will ask you to choose one of the following two options. Your choice is confirmed in your order ticket.

Option A: Full ownership transfer

• Once the full price has been paid, ownership of the delivered website, including its source code and project files, is transferred to you in full.
• You are free to host, modify and manage the website yourself or through a third party.
• After the transfer, Agony Studios no longer maintains, updates or supports the website, and no further changes can be requested from us for that project.

Option B: Managed by Agony Studios

• Agony Studios retains ownership of the website’s source code and project files. You receive the right to use the delivered website for your project.
• We remain available to update the website for you. Each update costs €20 and is requested and confirmed through a Discord ticket before any work begins.
• You can request a full ownership transfer at a later date; any terms for this are agreed in a ticket.

Under either option, we may show the finished website in our portfolio unless you ask us not to.

9. Hosting, domains and third-party services

Unless included in your agreed scope, hosting, domain names and third-party subscriptions are not part of the price and are your responsibility. We’re not responsible for outages or changes of third-party services.

10. Liability

We build every project with care. We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise, our liability is limited to the price paid for the project concerned, as far as the law allows.
